Introduction

These Terms of Service (hereinafter "Terms") govern your use of the VisUp service, a SketchUp plugin provided by TAPP Studio s.r.o. By using the service, you agree to these Terms.

Service Provider

Definitions

• Service - VisUp plugin and related web services for AI visualization generation
• User - Natural or legal person who uses the Service
• Credits - Virtual units used for generating visualizations
• Plugin - VisUp extension for SketchUp

Registration and Account

Registration is required to use the Service. You agree that:

• You are at least 18 years old or have parental consent
• You will provide accurate and complete information
• You will protect your login credentials
• You are responsible for all activity on your account

Service Description

VisUp is a SketchUp plugin that uses Google Gemini artificial intelligence to transform 3D models into photorealistic visualizations.

Credit System

The service operates on a prepaid credit basis:

• Credits are non-refundable
• Credits cannot be transferred between accounts
• Credits do not expire while the account is active

Payments

You pay for credits in advance through our payment partners.

• Prices are listed in USD
• VAT may be added depending on your location
• We accept card payments via Stripe

Intellectual Property

VisUp, its logo, design and code are our intellectual property protected by copyright and other laws.

You remain the owner of your original 3D models and input data.

You may use generated visualizations for personal and commercial purposes. We grant you a non-exclusive license to use the generated content.

Acceptable Use

You agree not to:

• Use the Service for illegal purposes
• Generate harmful, offensive or illegal content
• Infringe intellectual property rights of third parties
• Abuse or overload our systems
• Attempt to reverse engineer or decompile the plugin

Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free or that it will meet your specific requirements. AI-generated content may contain inaccuracies.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from the use or inability to use the Service.

Our total liability is limited to the amount you have paid us in the last 12 months.

Termination

You can terminate your account at any time by contacting our support.

We may suspend or terminate your access if you violate these Terms.

Upon termination, you lose access to the Service and unused credits are forfeited.

Changes to Terms

We may update these Terms. We will notify you of changes via email or website notice. By continuing to use the Service after changes, you agree to the new Terms.

Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes will be resolved by the competent courts in the Czech Republic.
